This Privacy Policy describes how we collect, use, disclose, store, and protect your personal information when you visit titan-training.ca, use our services, communicate with us, or otherwise engage with Titan Training.

This Policy complies with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), Canada's Anti-Spam Legislation (CASL), the US Telephone Consumer Protection Act (TCPA), the California Consumer Privacy Act (CCPA) / California Privacy Rights Act (CPRA), the CAN-SPAM Act, and applicable provincial, state, and federal privacy regulations.

  • Payment Information: Credit card or payment details (processed securely through third-party payment processors — we do not store full card numbers)
  • Account Information: Login credentials, preferences, and communication history
  • Inquiry & Form Data: Any information submitted through contact forms, consultation requests, or booking forms on our website
  • Consent Records: Records of consents you provide, including SMS opt-in, email opt-in, and marketing preferences

2.2 Information Collected Automatically

When you visit our website, we may automatically collect certain information through cookies, pixels, and similar technologies, including:

  • To send promotional and marketing communications (with your consent), including emails, text messages (SMS/MMS), and newsletters
  • To personalize your experience and tailor content and recommendations
  • To conduct health and fitness assessments and develop customized training programs
  • To respond to your inquiries, requests, and support needs
  • To improve our website, services, and business operations through analytics
  • To comply with legal obligations, enforce our Terms and Conditions, and protect our rights and safety
  • To detect, prevent, and address fraud, security issues, or technical problems

4. SMS / Text Messaging Privacy (A2P 10DLC Compliance)

If you opt in to receive text messages from Titan Training, the following applies:

4.1 What We Collect

When you opt in to our SMS program, we collect your mobile phone number, the method and date of your opt-in consent, and any responses you send to our messages (e.g., STOP, HELP).

4.2 How We Use Your Phone Number

Your phone number is used exclusively to send you the types of messages you consented to receive, which may include appointment reminders, booking confirmations, promotional offers, and service updates.

4.3 No Sharing for Marketing

We do not sell, rent, lease, or share your phone number or SMS opt-in data with any third parties or affiliates for their independent marketing purposes. Your phone number may be shared only with our authorized messaging platform provider(s) solely for the purpose of delivering messages on our behalf. These providers are contractually bound to protect your data and use it only as directed by us.

4.4 Consent & Opt-Out

Your consent to receive SMS messages is not required as a condition of purchasing any service or product. You may revoke consent at any time by replying STOP to any text message. After opting out, you will receive a single confirmation message and no further texts. You may re-opt-in at any time by texting START or completing a new opt-in form.

4.5 Data Retention for SMS

We retain your phone number and opt-in/opt-out records for as long as necessary to fulfill the purposes described herein, to comply with legal obligations, and to maintain accurate records of consent. Upon opt-out, your number is moved to a suppression list to prevent future messaging.

5. Email Communications (CASL & CAN-SPAM Compliance)

We send commercial electronic messages only where we have obtained your express consent (or where implied consent exists under CASL). Every marketing email includes our business name, contact address, and a clear unsubscribe mechanism. Unsubscribe requests are honoured within 10 business days in accordance with CASL and CAN-SPAM requirements.

We do not use misleading subject lines or false header information. Transactional emails (e.g., booking confirmations, receipts) may still be sent after unsubscribing from marketing emails as they are necessary for the provision of services.

6. Cookies & Tracking Technologies

Our website uses cookies and similar tracking technologies to enhance your experience, analyze usage, and support marketing efforts. Types of cookies we may use include:

  • Business Transfers: In connection with a merger, acquisition, reorganization, or sale of assets, in which case your information may be transferred as part of the transaction. You will be notified of any such change.
  • With Your Consent: Where you have provided explicit consent for a specific disclosure.

We do not sell your personal information to third parties.

8. Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, to comply with legal and regulatory obligations, to resolve disputes, and to enforce our agreements. Specific retention periods include:

  • Client records: Retained for the duration of the client relationship plus 7 years, or as required by law
  • Financial / transaction records: Retained as required by Canadian tax law (typically 6–7 years)
  • SMS consent records: Retained for the duration of the messaging relationship plus 5 years after opt-out
  • Email consent records: Retained for the duration of the messaging relationship plus 3 years after unsubscribe
  • Website analytics data: Retained in accordance with our analytics provider's retention policies

When personal information is no longer needed, it will be securely deleted or anonymized.

9. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, alteration, disclosure, or destruction. These measures include encrypted data transmission (SSL/TLS), restricted access controls, secure hosting infrastructure, and regular security assessments.

However, no method of electronic transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee its absolute security. You are responsible for maintaining the confidentiality of your account credentials.

10. Your Privacy Rights — Canada (PIPEDA)

Under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws, you have the right to:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Request correction of inaccurate or incomplete personal information
  • Withdrawal of Consent: Withdraw consent for the collection, use, or disclosure of your personal information (subject to legal or contractual obligations)
  • Complaint: File a complaint with the Office of the Privacy Commissioner of Canada if you believe your privacy rights have been violated

To exercise any of these rights, contact our Privacy Officer using the information in Section 16 below. We will respond to your request within 30 calendar days, as required by PIPEDA.

11. Your Privacy Rights — United States (CCPA / CPRA)

If you are a resident of California or another US state with consumer privacy legislation, you may have additional rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), and similar state laws. These rights may include:

  • Right to Know: Request disclosure of the categories and specific pieces of personal information we have collected about you, the sources of collection, the purposes of collection, and the categories of third parties with whom it was shared
  • Right to Delete: Request deletion of personal information we have collected, subject to certain legal exceptions
  • Right to Correct: Request correction of inaccurate personal information
  • Right to Opt Out of Sale/Sharing: We do not sell your personal information. If this practice changes, you will have the right to opt out.
  • Right to Non-Discrimination: You will not be discriminated against for exercising your privacy rights

To submit a verifiable consumer request, contact us using the information in Section 16 below. We may need to verify your identity before processing your request. We will respond within 45 calendar days of receiving a verifiable request, with a possible 45-day extension if necessary.

12. Telephone Consumer Protection Act (TCPA) Notice — US Users

For users located in the United States, we comply with the Telephone Consumer Protection Act (TCPA). By opting in to receive text messages or calls from Titan Training:

  • You provide prior express written consent to receive autodialed, pre-recorded, or artificial voice calls and text messages at the phone number you provided
  • Your consent is not a condition of purchase
  • Standard message and data rates may apply
  • You may revoke consent at any time by replying STOP or contacting us directly

13. Children's Privacy

Our Services are not directed to individuals under the age of 13 (or under 16 in certain jurisdictions). We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13 without verifiable parental consent, we will take steps to delete that information promptly. If you believe a child has provided us with personal information, please contact us immediately.

14. International Data Transfers

Titan Training is based in Ontario, Canada. Your personal information may be processed or stored in Canada and/or the United States, where our service providers maintain servers and facilities. By using our Services, you consent to the transfer and processing of your information in these jurisdictions, which may have different data protection laws than your country of residence. We take reasonable steps to ensure your data is treated securely and in accordance with this Policy regardless of where it is processed.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. When we make material changes, we will update the "Last Updated" date at the top of this page. We encourage you to review this Policy periodically.
